Vehicle impoundment for no insurance or driver’s license

September 30, 2012

This one would be comical if it were not for the staggering abuse of power that it represents. So, let’s imagine that a police officer abuses their authority and impounds a vehicle for not having proof of insurance or no driver’s license, undoubtedly in a circumstance where no harm to person or property has occurred. The city pays to have the vehicle impounded.

When our harassed citizen finally gets their day in court, they are able to show that they did have insurance or their driver’s license. The judge lets the victim off and they retrieve their vehicle. As there was no real infraction, the citizen retrieves the vehicle but the city is left on the hook for the towing expenses. Waaaaaa.

TML’s position is to “Oppose legislation that would erode the authority of cities to tow vehicles for no insurance or no driver’s license, or exempt motorists from having to pay any vehicle impoundment fee.”

How about the municipality issue a citation? How is towing the vehicle a public service? I say, make the city pay for the towing as the fee for their over reach and stupidity. In fact, I’d go so far as to say that the resident should be compensated for their time and lost wages for having to deal with a stupid government.
